Harvey Weinstein will not face a fourth trial on a New York rape charge as prosecutors have dropped the case following his accuser’s reluctance to testify again. The former movie mogul remains convicted of another sexual felony in New York and additional charges in California while serving time in prison. The unresolved New York rape charge stemmed from an overturned conviction and two mistrials.
Jessica Mann, a hairstylist and actor, testified at all three trials, alleging that Weinstein raped her in a Manhattan hotel in 2013. Despite Weinstein’s denial, claiming their interactions were consensual, Mann expressed her unwillingness to continue enduring the legal process, stating that the prolonged case had caused more harm than good.
Prosecutor Nicole Blumberg quoted Mann’s letter in court, acknowledging her bravery but ultimately agreeing to dismiss the case due to Mann’s emotional distress. Judge Curtis Farber officially dismissed the charge, with Weinstein returning to jail awaiting sentencing on a separate sexual assault conviction in New York.
Following the New York proceedings, Weinstein faces a lengthy prison term as prosecutors seek a 20-year sentence. Subsequently, he is expected to serve a 16-year sentence in California for a separate rape conviction, with appeals pending for both cases. Weinstein’s legal team expressed relief at the dismissal of Mann’s allegation, affirming his innocence.
Mann detailed her tumultuous relationship with Weinstein, stressing her attempts to resist his advances during the alleged assault in 2013. The latest trial took a toll on Mann, who struggled with health issues and emotional distress, further complicating her testimony and leading to a premature court adjournment.
