Ontario Judge Drops Charges in Fatal Markham Crash

Outside a courthouse in Ontario, a large crowd gathered in shock and sadness on Friday as an Ontario judge dropped charges against a driver responsible for a fatal crash in Markham. Anthony Baglieri from Vaughan faced three counts of dangerous driving causing death, but Justice Mark Edwards ruled that the evidence did not prove his guilt beyond a reasonable doubt.

The tragic incident occurred on October 12, 2022, when Baglieri, driving a dump truck with a trailer, ran a red light at the intersection of Markham Road and Elson Street, resulting in a collision with an eastbound Acura. The crash claimed the lives of two siblings, Pateeran Puvanendran, 21, and Neluxsana Puvanendran, 23, while their mother, Srirathy Shanmuganathan, 52, sustained critical injuries and later passed away.

Despite the devastating outcome, Justice Edwards determined that Baglieri’s actions were not criminal. The court acknowledged that Baglieri was not intoxicated or speeding and may have been distracted by factors like sun glare, a driver in his blind spot, and emergency lights from other vehicles. The judge emphasized that while the incident was a tragedy caused by Baglieri’s mistake, it did not amount to a criminal offense.

The emotional verdict led to a demonstration outside the courthouse in Newmarket, Ontario, where members of the Tamil community expressed their frustration. Puvanendran Poobalasingam, the father and husband of the victims, was visibly distraught, surrounded by supporters as he lamented the loss of his family. The crowd demanded justice, echoing the sentiments of Rojana Fernando, a cousin of the deceased siblings, who emphasized the impact of the tragedy on their close-knit family.

Although the trial initially involved a jury, it concluded with a ruling by the judge alone. Family friend Aranee Murugananthan vowed to continue fighting for justice, expressing the family’s determination to seek further legal action. Baglieri’s defense lawyer, Ehsan Ghebrai, acknowledged his client’s remorse and relief following the ruling, highlighting Baglieri’s clean driving record prior to the incident.

Despite the court’s decision, the grieving family and their supporters remain resolute in their pursuit of justice and accountability for the tragic loss of three beloved individuals in the Markham crash.
