Chinese Whistleblower Granted U.S. Asylum

In an exclusive interview, lawyer Chen Chuangchuang discussed the case of Guan Heng, a Chinese whistleblower who exposed the existence of detention camps in Xinjiang. Guan, a YouTuber from Henan, China, ventured into Xinjiang in October 2021 to capture footage of the hidden camps after reading a BuzzFeed News report detailing China’s construction of these facilities to hold thousands of Uyghurs. His documentation led to a chain of events that ultimately led to his asylum claim being granted by a U.S. judge after a five-year struggle.

Before embarking on his journey, Guan had observed unusual activities in Xinjiang during a visit in 2019. Witnessing the heavy military presence and surveillance in the region, he felt compelled to take action but lacked the necessary context at the time. It was not until he came across the Pulitzer Prize-winning series “Built To Last” by BuzzFeed News during the COVID-19 lockdown that he felt the urgency to expose the truth. Fearing reprisal from Chinese authorities, Guan fled to the U.S. via Ecuador and the Bahamas, where he sought asylum upon arrival.

Despite living in the U.S. for four years awaiting a review of his asylum request, Guan encountered a setback when he was apprehended by Immigration and Customs Enforcement (ICE) last summer during a raid targeting his roommates. This “collateral arrest” prompted a legal battle, with the Department of Homeland Security pushing for Guan’s deportation to Uganda, citing his illegal border crossing. However, human rights advocates and lawmakers rallied behind Guan, emphasizing the significance of his footage in exposing human rights abuses in Xinjiang and influencing policy decisions.

Following a recent hearing in Napanoch, N.Y., where Guan was deemed a credible witness and granted asylum, he remains in custody pending a decision from the Department of Homeland Security on a possible appeal. Despite the challenges faced by asylum seekers in the current political climate, Guan’s successful case stands as a rare victory and a testament to his perseverance in seeking justice and safety.
