The Supreme Court of Canada has made a decision to void the narrow victory of a federal Liberal candidate in the 2025 federal election to uphold public confidence in the electoral system. This move ensures that election outcomes are not influenced by identifiable and amendable administrative mistakes.
Tatiana Auguste, the Liberal candidate, had initially been declared the winner in the Terrebonne riding in the Montreal area by just one vote, defeating the incumbent Bloc Québécois candidate, Nathalie Sinclair-Desgagné, in April 2025. Following a complaint from a Bloc supporter who alleged that their attempt to vote by mail using a special ballot was disregarded, Sinclair-Desgagné contested the election results and called for a byelection.
Although a Superior Court judge initially dismissed Sinclair-Desgagné’s plea for a new election, the Supreme Court overturned that decision in a split verdict delivered in February. Justice Mahmud Jamal, writing for the majority, highlighted that an Elections Canada staff member had been aware of incorrect postal codes on some voters’ envelopes for several weeks, yet no corrective actions were taken by the agency.
Subsequently, Auguste secured victory once again in the byelection held in April, retaining the Terrebonne riding.
